Does the effect of the Google book search settlement extend to the Japanese copyright holders?

昨年アメリカの大学生からメールがありました。グーグルブック和解に関する私の見解に対する問い合わせでした。ここにその回答した内容の一部をご紹介します。

My this opinion relates with the problem of the effect to foreign countries concerned in The Google Book Search Copyright Class Action Settlement
The United States District Court for Southern District of New York. in the Authors Guild, Inc., Et al. V. Google Inc., the case [Case Number: 05 CV8136 (SDNY)] has made the preliminary approval for settlement.The notice was announced in January 2009 through the website of google Inc. (below, "Google" called.).That is the so-called Google Book Search Copyright Class Action Settlement (the "settlement"called.) .
There was the expression in the settlement, "Note to authors and publishers outside the United States: This settlement may affect the right of you.". Therefore it was thought that the effect of the settlement extended to the Japanese author.
However, Given the spirit of the Berne Convention and the laws of our country(Japanese laws), rather I think that it is proper to think that the effect does not occur.
After that Japan Cartoonist Association statement on the settlement I've created was published, the opinions of the same purpose were announced as government statement in Germany and France. The American Department of Justice had a question for the settlement concerned afterwards, too. The problem of the effect to foreign countries concerned in the settlement terminated.
